DPDP Gap Assessment & Data Audit
We map what personal data you collect, where it flows and who can access it, then show the gaps against the DPDP Act.
Most DPDP Act obligations apply from May 2027, with penalties of up to ₹250 crore. eParth Youth builds the DPDP compliance software your business needs, and adds it to the apps you already run.
The Digital Personal Data Protection Act, 2023 is India's data protection law. It sets rules for how organisations collect, use, store and delete the digital personal data of people in India. The DPDP Rules, 2025 explain how the Act works in practice.
Under the Act, a business that decides why and how personal data is processed is a Data Fiduciary. The person the data belongs to is the Data Principal. Data Fiduciaries must be transparent, ask for valid consent, protect the data, and respect the rights of Data Principals.
The DPDP Act applies to organisations of every size that process digital personal data in India, and to foreign companies that offer goods or services to people in India.
The Data Protection Board of India can impose penalties for each breach of the Act. These are the maximum amounts in the Act's schedule.

The DPDP Act, 2023 applies to any organisation that processes digital personal data in India, and to organisations outside India that process personal data to offer goods or services to people in India. It covers businesses of every size, with very limited exemptions.
The DPDP Rules, 2025 were notified in November 2025 with a phased rollout. Most obligations for businesses, such as notices, consent, security safeguards, breach notification and data principal rights, apply from May 2027, 18 months after notification.
The Act's schedule sets penalties of up to ₹250 crore for failing to take reasonable security safeguards, up to ₹200 crore for failing to notify a personal data breach, up to ₹200 crore for breaching obligations on children's data, and up to ₹150 crore for Significant Data Fiduciary obligations.
To achieve DPDP compliance, your business must: (1) Conduct a personal data audit and flow mapping, (2) Implement an itemised consent management platform (CMP) with withdrawal options, (3) Publish clear privacy notices in English and scheduled languages, (4) Establish automated Data Principal Rights workflows (access, correction, erasure), (5) Enforce 72-hour breach response mechanisms, and (6) Implement data retention limits with automatic data purging.
Under Section 9 of the DPDP Act 2023, processing personal data of individuals under 18 years requires verifiable consent from a parent or lawful guardian. Additionally, organisations cannot engage in behavioral monitoring, tracking, or targeted advertising directed at children.
A DPDP Consent Manager or CMP captures, records, timestamps, and manages user consent across websites and apps. It allows Data Principals to give, review, or withdraw consent at any time, while maintaining tamper-proof audit trails to demonstrate compliance to the Data Protection Board of India.
Yes. Schools and edtech platforms process children's personal data, which needs verifiable consent from a parent or guardian under the DPDP Act. Tracking, behavioural monitoring and targeted advertising aimed at children are also restricted.
